Version in force as of [27 October 2026]. These terms are a translation; only the French version is legally binding.
1.1 These general terms and conditions of sale (“Terms”) govern distance sales of products concluded on the website www.mizensir.com (“the Site”) between the Seller and any natural person acting for purposes outside their trade or profession (“the Customer”).
1.2 The Customer confirms having read and accepted the Terms by ticking the box provided before placing their order. The applicable Terms are those in force on the date of the order. They can be viewed, downloaded and printed at any time from the Site.
1.3 The Seller may amend the Terms at any time. Amendments apply only to orders placed after they are published online.
1.4 These Terms do not apply to purchases made in Mizensir boutiques or on www.mizensir.ch, which are governed by their own terms.
The Site is operated by BV DISTRIBUTION, a French simplified joint-stock company with a sole shareholder (SASU) and share capital of €1,000, whose registered office is at 91 rue Ambroise Martin, 74120 Megève, France, registered with the Annecy Trade and Companies Register under no. 822 585 311, EU VAT no. FR 91 822 585 311 (“Mizensir” or “the Seller”).
Customer service:
3.1 Prices are shown in the currency of the selected delivery country, all taxes included. For deliveries within the European Union, they include the VAT applicable in the destination country.
3.2 Shipping costs are added to the product price. They are shown on the [Shipping costs and times] page and summarised before the order is confirmed.
3.3 Deliveries outside the European Union are shipped DDP (delivered duty paid). Customs duties and import taxes of the destination country are calculated at checkout and added to the shipping costs before payment. The Customer has no additional duties or taxes to pay on receipt of the parcel.
3.4 The applicable price is the one displayed when the order is confirmed. In the event of an obvious pricing error (manifestly derisory price), the Seller may cancel the order and refund the Customer.
4.1 The Customer selects the products, checks the contents of their basket, enters their delivery and billing details, then chooses a delivery method. Before paying, they can review the details and total price of their order and correct any errors. The order is confirmed by clicking the payment button, which constitutes an obligation to pay.
4.2 Payment is made online using the methods offered on the payment page, including bank card (Visa, Mastercard, American Express, Cartes Bancaires), PayPal, Apple Pay, Shop Pay and [local and deferred payment methods to be completed]. Payments are processed by secure providers ([Shopify Payments, PayPal…]); the Seller never has access to the Customer's full bank details.
4.3 The Customer's account is charged [when the order is confirmed / on dispatch]. For deferred payment, the terms of the relevant provider also apply.
4.4 The Seller confirms the order by email. The contract is concluded on receipt of this confirmation, which summarises the products, the total price and these Terms.
4.5 The Seller may refuse an order in the event of a previous payment dispute with the Customer, suspected fraud, or quantities clearly intended for resale. Products are sold exclusively to consumers for their personal use.
4.6 Data recorded by the Seller and its payment providers constitutes proof of transactions, unless the Customer proves otherwise.
5.1 The essential characteristics of the products (volume, composition, list of ingredients, precautions for use) are shown on each product page. Photographs are as accurate as possible; slight variations in colour may occur.
5.2 Products are offered while stocks last. If a product is unavailable after ordering, the Customer is informed and refunded for the undelivered products as soon as possible, and no later than within 14 days.
5.3 Some products (perfumes, products containing alcohol or flammable products) are subject to transport restrictions and cannot be delivered to certain countries or by certain shipping methods. These restrictions are indicated before the order is confirmed.
6.1 Engraving. The Customer may request engraving on certain bottles or cases. The text entered is the Customer's sole responsibility; the Seller may refuse text that is unlawful, offensive or infringes third-party rights. An engraved product is goods made to the Customer's specifications: it carries no right of withdrawal (article 8.6). The Customer is informed of this and expressly accepts it when choosing engraving.
6.2 Samples. A sample of the fragrance may be included with the purchase of a perfume. It allows the Customer to discover the fragrance before opening the bottle.
6.3 Gifts and offers. Gifts offered from a certain purchase amount, free engraving and promotional codes are valid under the conditions and for the period shown on the Site. Unless otherwise stated, codes cannot be combined, may be used only once per Customer and cannot be exchanged for cash. In the event of withdrawal, any gift received must be returned with the order; failing this, its value as shown on the Site may be deducted from the refund.
6.4 Subscription. Subscription purchases are governed by the [Subscription Policy], which sets out the discount granted, the ordering commitment, and the conditions of cancellation and recovery of the discount if the commitment is not met. The Customer accepts it before subscribing.
6.5 Loyalty programme. The “Cercle Mizensir” programme is governed by its own [terms], available on the Site.
7.1 Products are delivered to the address given by the Customer, in the countries listed on the [Shipping costs and times] page. We do not deliver to PO boxes or military addresses.
7.2 The delivery time is shown before the order is confirmed. Failing this, delivery takes place no later than 30 days after the contract is concluded. The Customer is informed of any delay as soon as possible.
7.3 If the delivery time is exceeded, the Customer may require the Seller in writing (including by email) to deliver within a reasonable additional period. If delivery does not take place within that period, the Customer may terminate the contract and is then refunded all sums paid within 14 days at the latest, in accordance with articles L216-6 and L216-7 of the French Consumer Code.
7.4 The Customer must provide an accurate and complete address. Reshipping costs resulting from an incorrect address provided by the Customer may be charged to them.
7.5 Transfer of risk. The risk of loss of or damage to the products passes to the Customer when they, or a third party designated by them other than the carrier proposed by the Seller, take physical possession of the products (article L216-4 of the French Consumer Code).
7.6 Checking on delivery. The signature of the Customer, or of the third party designated by them, on delivery of the parcel serves as proof that it was delivered in apparently good condition, unless proven otherwise. The Customer should therefore check the condition of the parcel in the carrier's presence before signing.
If the parcel is damaged, opened, poorly resealed or unusually light, the Customer must refuse delivery with the carrier and inform customer service without delay. If they cannot check the parcel on the spot, they must record specific reservations on the delivery note (for example “damaged parcel” or “light parcel, not checked”).
Any broken or missing product discovered after opening must be reported to customer service as soon as possible, if possible within 7 days, with photos of the parcel and its contents. This report helps process the claim with the carrier but does not affect the Customer's rights under the statutory warranties (article 9).
8.1 Period. In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days to withdraw, without giving any reason and without bearing any costs other than those provided for in articles 8.3 and 8.5. The period runs from the day on which the Customer, or a third party designated by them other than the carrier, takes physical possession of the last product in the order.
8.2 How to withdraw. The Customer notifies their decision before the period expires by one of the following means:
The Seller acknowledges receipt of the withdrawal without delay, by email, stating the date and time of receipt.
8.3 Returning the products. The Customer returns the products no later than 14 days after notifying their decision, to the following address: Mizensir – Service Retours, 91 rue Ambroise Martin, 74120 Megève, France. Return shipping costs are borne by the Customer. Parcels sent carriage forward will be refused. The Seller recommends tracked shipping and packaging that protects the products during transport; the Customer bears the risk of the return until it is received.
8.4 Refund. The Seller refunds all sums paid, including the original shipping costs (up to the cost of the least expensive standard delivery method offered), no later than 14 days after being informed of the withdrawal. The Seller may withhold the refund until it has received the products or until the Customer has supplied proof of having sent them back, whichever is earlier. The refund is made using the payment method used for the order, unless the Customer expressly agrees otherwise, and at no cost to the Customer.
8.5 Diminished value. The Customer may examine the product to the extent necessary to establish its nature and characteristics, without unsealing it. The Customer is liable for any diminished value resulting from other handling (article L221-23 of the French Consumer Code). A deduction is made from the refund in particular where the case or product is damaged, stained or written on, or where an item of the order (case, sample, gift) is not returned.
If the Seller exceptionally agrees to accept the return of an unsealed product, a reconditioning fee of €50 is deducted from the refund, in addition to the return shipping costs borne by the Customer. This fee covers sending the product back to the subcontractor and resealing it outside the production line.
An unsealed or used product cannot be returned (article 8.6). To discover the fragrance risk-free, the Customer is invited to use the sample included with the order before removing the protective film or opening the bottle.
8.6 Exceptions. In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:
9.1 Independently of the right of withdrawal, the Customer benefits by law and free of charge from the statutory warranty of conformity (articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code).
9.2 Statutory warranty of conformity. The Customer has 2 years from delivery of the product to take action. Any lack of conformity appearing within this period is presumed to have existed at the time of delivery, without the Customer having to prove it. The Customer may obtain repair or replacement of the product or, failing that, a price reduction or termination of the contract with a refund, under the conditions of articles L217-8 et seq.
9.3 Warranty against hidden defects. The Customer may take action within 2 years of discovering the defect and choose between cancellation of the sale or a price reduction (article 1644 of the French Civil Code).
9.4 Procedure. The Customer contacts customer service (article 2), stating their order number, the defect found and, if possible, providing photos. Return costs for a non-conforming product are borne by the Seller.
9.5 Mandatory information box. [Insert here, verbatim, the information box on the statutory warranty of conformity set out in the appendix to article D211-2 of the French Consumer Code (official text available on Légifrance). It must not be reworded.]
10.1 The Seller is fully liable to the Customer for the proper performance of the contract, in accordance with article L221-15 of the French Consumer Code. It may be released from all or part of its liability by proving that the non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
10.2 The Seller is not liable for damage resulting from use of the products contrary to their intended purpose or to the precautions for use stated on the product or its product page.
Neither party is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code. The Customer is informed without delay when it occurs. If the impediment lasts more than 30 days, either party may terminate the order; any sums already paid are then refunded to the Customer within 14 days.

14.2 These Terms are drawn up in French. In the event of translation, only the French text is legally binding.
15.1 Any complaint should be sent to customer service at customerservice@mizensir.com or by post to the address in article 2, stating the order number.
15.2 In accordance with articles L612-1 et seq. of the French Consumer Code, if a prior written complaint to customer service has not resolved the matter, the Customer may refer it free of charge to the consumer mediator to which the Seller belongs: [mediator name], [postal address], [website].
15.3 Failing an amicable settlement, the dispute is brought before the competent court under ordinary rules. In particular, the Customer may bring proceedings before the court of the place where they lived when the contract was concluded.
