These terms are a translation; only the French version is legally binding.
The website www.mizensir.com (“the Site”) is published by Mizensir SA, whose registered office is at Chemin de la Pallanterie 11, 1252 Meinier, Switzerland, owner of the Mizensir trademarks and content.
It is operated by BV DISTRIBUTION, a French SASU with share capital of €1,000, 91 rue Ambroise Martin, 74120 Megève, France, Annecy Trade and Companies Register 822 585 311 (“Mizensir”), which handles the sales made on the Site.

These terms of use (“Terms”) set out the conditions for accessing the Site and using its services. They apply to anyone browsing the Site (“the User”).
Purchases made on the Site are governed by the [General Terms and Conditions of Sale]. The processing of personal data is described in the [Privacy Policy] and the use of cookies in the [Cookie Policy].
Using the Site implies acceptance of the Terms in force, which are available at any time in the footer. Mizensir may amend them to reflect changes to the Site or to regulations. The applicable version is the one online at the time of your visit.
4.1 The Site is accessible free of charge, excluding connection costs borne by the User. Mizensir endeavours to ensure continuous access but may interrupt it for maintenance, updates or technical reasons, without this giving rise to any compensation.
4.2 Customer accounts are reserved for adults. The User undertakes to provide accurate information and to keep it up to date. They are responsible for keeping their login details confidential and for any use of their account. They inform Mizensir without delay of any unauthorised use.
4.3 The User may delete their account at any time from their customer account or by writing to customerservice@mizensir.com. Mizensir may suspend or close an account in the event of fraud or serious breach of the Terms, after informing the User, except in urgent cases.
5.1 The trademarks Mizensir, Mizensir Genève, Mizensir Parfums and mizensir.com, the logos, the names of the creations and all content on the Site (texts, photographs, videos, visuals, bottles and packaging, graphic design, structure) are protected by copyright, design law and trademark law. They belong to Mizensir SA, BV Distribution or their partners.
5.2 The User may browse the Site and print extracts for strictly personal and private use. Any other reproduction, representation, adaptation or use, in whole or in part, in particular for commercial or advertising purposes, is prohibited without prior written permission and constitutes infringement punishable under the French Intellectual Property Code.
5.3 Other trademarks mentioned on the Site belong to their respective owners and are used only with their permission or to identify the products concerned.
Reviews published on the Site come from customers who have purchased the product concerned. Mizensir may refuse or remove a review that is abusive, defamatory, off-topic or unlawful, without excluding negative reviews. How reviews are collected, checked and published is explained [on the dedicated page / in the review tool].
The User undertakes to use the Site fairly and lawfully. In particular, they must not interfere with its operation or security, extract its content in bulk by automated means, or publish unlawful content on it.
The User may subscribe to the Mizensir newsletter and unsubscribe at any time via the link in each email or from their customer account. Details are set out in the [Privacy Policy].
The Site may contain links to third-party websites (social networks, partners, carriers). Mizensir does not control their content and is not responsible for their practices; these websites have their own terms and privacy policies.
10.1 Mizensir takes care to ensure the accuracy of the information published on the Site and may update it at any time. The product characteristics applicable to an order are those displayed at the time of ordering.
10.2 Mizensir takes reasonable measures to keep the Site secure but cannot guarantee that it is entirely free of errors, interruptions or viruses. It cannot be held liable for damage resulting from use of the Site in breach of these Terms, a failure of the User's network or equipment, or force majeure. This limitation does not apply to damage resulting from fault on the part of Mizensir, nor to the User's statutory rights, in particular as a consumer.
11.1 These Terms are governed by French law. This choice does not deprive a consumer User residing in another country of the protection of the mandatory provisions of the law of their country of residence.
11.2 Failing an amicable settlement, the dispute is brought before the competent courts. In particular, a consumer User may bring proceedings before the court of the place where they lived at the time of the events.
